Section 3
Right to acquire immovable property

(1) If any immovable property is needed or is likely to be needed for the Government of Nepal, provincial government and local level for the purpose of any public work, the Government of Nepal-
(a) A written notice in the name of the owner of the property or any other person using the property to submit to the Government of Nepal within 35 days of the receipt of the notice, if there is any reason why the property should not be acquired from the Government of Nepal. should be given, and
(b) By order, the owner of the property or any other person may direct that the property shall not be sold, altered in size or restored to any kind without the approval of the Government of Nepal within 35 days from the date of receipt of the order.
(2) If any person using the property or having a claim or interest in it shows any reason, after considering it, it is appropriate or necessary to acquire the property, the Government of Nepal may acquire such property by written order. and may issue such other orders as may be deemed necessary and appropriate in relation to such acquired works. Provided that none of the following properties or any part thereof shall be acquired-
(a) used by the person for the purpose of his personal or his immediate family's residence, or
(b) A place of religious worship or a public place that is used only for the purpose of a school, hospital, public library, hospice or orphanage, or a public place that is used for the purpose of staying persons related to the endowment work of such religious worship, school, hospital, library or orphanage. However, if the acquired property has been used as a residence by any person since 2 months prior to the date of notification under sub-section (1), the government of Nepal will arrange for such person to have another place of residence as deemed appropriate.
(3) An order of acquisition made under this section shall not be questioned in any court
